Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Vincent mobile application ("App" or "Service") operated by Arctec Yazilim Teknolojileri Limited Sirketi ("Arctec", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Service Description

Vincent is an AI-powered creative platform that allows users to generate videos and images using artificial intelligence. The Service includes, but is not limited to:

• Text-to-video generation from text prompts
• Photo-to-video animation from uploaded images
• Video style transfer and transformation
• AI image generation and image-to-image transformation
• Trending effects and curated creative templates

2. Account & Eligibility

You must be at least 13 years of age to use the Service. By using the App, you represent that you meet this age requirement. If you are under 18, you must have your parent or legal guardian's consent to use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Credits & Payments

• The Service operates on a credit-based system. Each generation request consumes a specific number of credits depending on the type of content and processing options selected.
• Credits can be purchased through in-app purchases via the Apple App Store or Google Play Store. All purchases are processed by the respective platform and are subject to their terms.
• Credit prices and generation costs may change at any time. We will display the credit cost before each generation request.
• If a generation fails due to a system error, credits will be refunded to your account. Credits consumed due to content moderation violations are non-refundable.
• Purchased credits are non-transferable and may not be exchanged for cash.

4. Subscriptions

Certain features may be available through subscription plans. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings.

Refunds for subscriptions are handled by Apple or Google in accordance with their respective refund policies.

5. User Content & Conduct

You retain ownership of the original content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process, store, and transmit that content solely for the purpose of providing the Service.

You agree NOT to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Upload content that infringes on the intellectual property rights of any third party.
• Use the Service to generate content depicting real individuals without their consent, especially in misleading or harmful contexts.
• Use the Service to create deepfakes or deceptive media intended to mislead or cause harm.
• Attempt to circumvent content moderation or safety systems.
• Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App.
• Use automated scripts, bots, or other means to access or interact with the Service.

We reserve the right to review, moderate, and remove any content that violates these Terms, and to suspend or terminate accounts that engage in prohibited conduct.

6. Content Moderation

All uploaded content is subject to automated moderation before processing. Content that is flagged for policy violations will be rejected. We reserve the right to refuse processing of any content at our sole discretion. Credits may be partially deducted for content that fails moderation checks.

7. Intellectual Property

The App, including its design, features, code, branding, and all related intellectual property, is owned by Arctec and protected by applicable copyright, trademark, and other intellectual property laws.

Content generated through the Service may be used by you for personal and commercial purposes, subject to the terms of the underlying AI providers and applicable laws. You are solely responsible for ensuring your use of generated content complies with all applicable laws and third-party rights.

8. Disclaimers

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
• We do not guarantee that AI-generated content will be accurate, complete, appropriate, or free of errors.
• We do not guarantee uninterrupted or error-free operation of the Service. Generation times may vary based on demand and processing complexity.
• The Service requires an active internet connection. We are not responsible for issues caused by connectivity problems on your end.
• We are not responsible for any charges incurred from your mobile network provider while using the Service, including data roaming charges.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Arctec shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Third-Party Services

The App integrates with third-party services, each governed by their own terms:

• Apple App Store / Google Play Store
• Google Play Services
• Firebase Analytics & Crashlytics
• RevenueCat (subscription management)
• AI generation providers (Replicate, RunwayML, Stability AI, and others)

We are not responsible for the practices or content of these third-party services. We encourage you to review their respective terms and privacy policies.

11. App Updates & Availability

We may release updates to the App from time to time. Some updates may be required for continued use of the Service. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

12. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. Any unused credits at the time of termination are forfeited unless otherwise required by applicable law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated through the App or by posting the updated Terms on this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
